Terms and Conditions

§ 1 DEFINITIONS

Business Days – days from Monday to Friday, excluding public holidays.
Consumer – consumer within the meaning of the Civil Code.
Buyer – any entity purchasing from the Store.
Regulation – this regulation.
Store – the online store pupstersocks.com operated by the Seller at the address https://www.pupstersocks.com.
Seller – Adam Figaj, entrepreneur running a sole proprietorship under the name Adfi Adam Figaj, NIP: 6172231562, REGON: 540069249

§ 3 TECHNICAL REQUIREMENTS

  1. Dla prawidłowego funkcjonowania Sklepu potrzebne jest:
    • urządzenie z dostępem do Internetu
    • przeglądarka internetowa obsługująca JavaScript oraz pliki cookies.
  2. In order to place an order in the Store, in addition to the requirements specified in section 1, an active email account is required.

§ 4 SHOPPING IN THE STORE

  1. The prices of goods displayed in the Store are the total prices for the goods, including VAT (Value Added Tax).
  2. The Seller points out that the total price of the order consists of the price for the goods indicated in the Store and, if applicable, the shipping costs for the goods.
  3. The selected goods for purchase must be added to the cart in the Store.
  4. Then, the Buyer selects from the available options in the Store: the method of delivery for the goods and the method of payment for the order, and provides the necessary data to complete the order.
  5. The order is placed when its content is confirmed and the Terms and Conditions are accepted by the Buyer.
  6. Placing an order is equivalent to concluding a sales agreement between the Buyer and the Seller.
  7. The Seller will provide the Consumer with a confirmation of the sales agreement on a durable medium no later than at the time of delivery of the goods.
  8. The Buyer may make purchases without registration by providing their details with each potential order.

§ 5 PAYMENTS

  1. For the placed order, payment can be made depending on the Buyer’s choice:
    1. By regular bank transfer to the Seller's bank account.
    2. Cash on delivery, i.e., in cash when the goods are delivered to the Buyer.
    3. By payment cards: Visa, Visa Electron, MasterCard, MasterCard Electronic, Maestro.

  2. If the Buyer chooses to pay in advance, the order must be paid within 7 business days from the order placement.
  3. The Seller informs that for some payment methods, due to their nature, payment by this method is only possible immediately after the order is placed.
  4. The provider of the online payment service is Blue Media S.A.

§ 6 ORDER FULFILLMENT

  1. The Seller is obligated to deliver the goods without defects.
  2. The order fulfillment time is 2-3 business days.
  3. If the customer chooses the payment method by bank transfer or credit card, the fulfillment time is calculated from the day the Seller's bank account or settlement account is credited.
  4. If, within a single order, the Buyer has purchased goods with different delivery times, the order will be fulfilled according to the item with the longest delivery time.

§ 7 RIGHT OF WITHDRAWAL

  1. The consumer has the right to withdraw from the contract concluded with the Seller through the Store, subject to § 8 of the Terms and Conditions, within 14 days without providing any reason.
  2. Termin do odstąpienia od umowy wygasa po upływie 14 dni od dnia:
    1. w którym Konsument wszedł w posiadanie towaru lub w którym osoba trzecia inna niż przewoźnik i wskazana przez Konsumenta weszła w posiadanie tego towaru.
    2. w którym Konsument wszedł w posiadanie ostatniej z rzeczy lub w którym osoba trzecia, inna niż przewoźnik i wskazana przez Konsumenta, weszła w posiadanie ostatniej z rzeczy w przypadku umowy zobowiązującej do przeniesienia własności wielu rzeczy, które dostarczane są osobno.

  3. In order for the Consumer to exercise the right of withdrawal from the contract, they must inform the Seller, using the details provided in § 2 of the Terms and Conditions, of their decision to withdraw from the contract through a clear statement (for example, a letter sent by post or information provided by email).
  4. To meet the deadline for exercising the right of withdrawal, it is sufficient for the Consumer to send information regarding the exercise of their right of withdrawal before the expiration of the withdrawal period.
  5. In the case of withdrawal from the concluded contract, the Seller shall refund to the Consumer all payments received from them, including the costs of delivering the goods (except for the additional costs resulting from the Consumer's choice of delivery method other than the cheapest standard delivery method offered by the Seller), immediately and in any case no later than 14 days from the day the Seller was informed of the Consumer's decision to exercise the right of withdrawal from the contract.
  6. The Seller will refund the Consumer using the same payment methods that were used by the Consumer in the original transaction, unless the Consumer agrees to another solution. In any case, the Consumer will not incur any fees related to this refund.
  7. The Seller may withhold the refund until the goods are received or until proof of their return is provided, depending on which event occurs first.
  8. The Seller requests that the goods be returned to the address: ul. Wojska Polskiego 55/9, 63-200 Jarocin without delay, and in any case, no later than 14 days from the day the Consumer informed the Seller about the withdrawal from the sales contract. The deadline is considered met if the Consumer returns the goods before the expiration of the 14-day period.
  9. The Consumer bears the direct costs of returning the goods.
  10. The Consumer is only responsible for the reduction in the value of the goods resulting from their use in a manner other than what was necessary to establish the nature, characteristics, and functioning of the goods.
  11. If the goods, due to their nature, cannot be returned by standard mail, the Consumer will also have to bear the direct costs of returning the goods. The Consumer will be informed by the Seller of the estimated amount of these costs in the product description in the Shop or during the order process.

§ 8 EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

  1. Prawo odstąpienia od umowy zawartej na odległość nie przysługuje Konsumentowi w odniesieniu do umowy:
    1. w której przedmiotem świadczenia jest rzecz nieprefabrykowana, wyprodukowana według specyfikacji Konsumenta lub służąca zaspokojeniu jego zindywidualizowanych potrzeb.
    2. w której przedmiotem świadczenia jest rzecz ulegająca szybkiemu zepsuciu lub mająca krótki termin przydatności do użycia.
    3. w której przedmiotem świadczenia jest rzecz dostarczana w zapieczętowanym opakowaniu, której po otwarciu opakowania nie można zwrócić ze względu na ochronę zdrowia lub ze względów higienicznych, jeżeli opakowanie zostało otwarte po dostarczeniu.
    4. w której przedmiotem świadczenia są rzeczy, które po dostarczeniu, ze względu na swój charakter, zostają nierozłącznie połączone z innymi rzeczami.
    5. w której przedmiotem świadczenia są nagrania dźwiękowe lub wizualne albo programy komputerowe dostarczane w zapieczętowanym opakowaniu, jeżeli opakowanie zostało otwarte po dostarczeniu.
    6. o dostarczanie dzienników, periodyków lub czasopism, z wyjątkiem umowy o prenumeratę.
    7. w której cena lub wynagrodzenie zależy od wahań na rynku finansowym, nad którymi przedsiębiorca nie sprawuje kontroli, i które mogą wystąpić przed upływem terminu do odstąpienia od umowy.
    8. o dostarczanie treści cyfrowych, które nie są zapisane na nośniku materialnym, jeżeli spełnianie świadczenia rozpoczęło się za wyraźną zgodą Konsumenta przed upływem terminu do odstąpienia od umowy i po poinformowaniu go przez przedsiębiorcę o utracie prawa odstąpienia od umowy.
  2. The right to withdraw from a distance contract does not apply to any entity other than the Consumer.

§ 9 COMPLAINTS

  1. In the event of a defect in the product, the buyer has the option to claim the defective product based on the warranty or guarantee regulated by the Civil Code, provided that a guarantee has been granted.
  2. Korzystając z rękojmi Kupujący może, na zasadach oraz w terminach określonych w Kodeksie cywilnym:
    1. złożyć oświadczenie o obniżeniu ceny
    2. przy wadzie istotnej – złożyć oświadczenie o odstąpieniu od umowy
    3. żądać wymiany rzeczy na wolną od wad
    4. żądać usunięcia wady
  3. The seller requests that claims based on the warranty be submitted to the postal or email address provided in § 2 of the Terms and Conditions.
  4. If it turns out that for the consideration of the complaint it is necessary to deliver the complained product to the Seller, the Buyer is obliged to deliver the product, in the case of the Consumer at the Seller's expense, to the address Wojska Polskiego 55/9, 63-200 Jarocin.
  5. If an additional warranty has been granted for the product, information about it, as well as its terms, is available in the product description in the Store.
  6. Complaints regarding the operation of the Store should be sent to the email address provided in § 2 of the Terms and Conditions.
  7. The Seller will process the complaint within 14 days.
  8. W przypadku, gdy postępowanie reklamacyjne nie przyniesie oczekiwanego przez Konsumenta rezultatu, Konsument może skorzystać m.in. z:

§ 10 PERSONAL DATA

  1. The data controller of the personal data provided by the Buyer when using the Store is the Seller.
  2. The Buyer’s personal data is processed mainly on the basis of the contract and for the purpose of its execution, in accordance with the principles set out in the General Data Protection Regulation (GDPR) of the European Parliament and the Council (EU). Detailed information regarding data processing by the Seller is included in the privacy policy available in the Store.

§ 11 RESERVATIONS

  1. It is prohibited for the Buyer to provide unlawful content.
  2. Each order placed in the Store constitutes a separate sales contract and requires separate acceptance of the Terms and Conditions. The contract is concluded for the duration and for the purpose of fulfilling the order.
  3. Contracts concluded based on these terms and conditions are concluded in Polish.
  4. In the event of a dispute with a Buyer who is not a Consumer, the court competent to hear the case will be the court located where the Seller’s registered office is.
  5. None of the provisions of these terms and conditions excludes or in any way limits the rights of the Consumer arising from legal regulations.
  6. Provisions concerning goods and sales contracts apply accordingly to digital content and contracts for the supply of digital content, unless the Terms and Conditions specify these matters separately.
